Terms and Conditions

1. Scope

These Terms and Conditions apply to all orders placed through MotoNavAdventure.com and all business relationships between the customer and MotoNavAdventure GmbH.

2. Contract Conclusion

The presentation of products in the online shop does not constitute a legally binding offer.

By placing an order, the customer submits a binding offer to purchase the selected products.

The purchase contract is concluded when MotoNavAdventure GmbH confirms the order or dispatches the goods.

MotoNavAdventure GmbH reserves the right to refuse orders without stating reasons.

3. Prices and Payment

All prices are stated in Swiss Francs (CHF) and include Swiss VAT where applicable.

Shipping costs and any additional charges are shown separately during checkout.

Payment methods available at checkout are considered accepted means of payment.

4. Shipping and Delivery

MotoNavAdventure GmbH currently delivers exclusively within Switzerland.

Orders with delivery addresses outside Switzerland will not be accepted.

Delivery times are estimates and are not guaranteed.

Further provisions regarding shipping costs, delivery times and delivery conditions are governed by the Shipping Policy.

Risk passes to the customer upon delivery of the goods.

5. Warranty

MotoNavAdventure GmbH warrants that products are free from material defects at the time of delivery.

Warranty claims do not cover damage caused by improper use, incorrect installation, unauthorized modifications, accidents, normal wear and tear, or external influences beyond our control.

All products are sold with a bring-in warranty. Unless mandatory Swiss law provides otherwise, the customer is responsible for all shipping costs associated with returning products to MotoNavAdventure GmbH for warranty assessment, inspection, repair or replacement.

Compatibility with third-party software, mobile networks, operating system updates, applications, accessories or services not supplied by MotoNavAdventure GmbH is not guaranteed unless explicitly stated otherwise.

Mobile Network and Voice Function (VoLTE)

Devices with SIM card support are primarily designed for navigation and mobile data communication.

Voice call functionality depends on carrier-specific VoLTE support and network approval. MotoNavAdventure GmbH does not guarantee voice call functionality.

Mobile data communication functionality remains unaffected.

6. Limitation of Liability

To the extent permitted by applicable Swiss law, MotoNavAdventure GmbH excludes liability for slight negligence.

Liability for indirect damages, consequential damages, loss of profit, loss of data and loss of use is excluded to the extent permitted by law.

Liability for intent, gross negligence, personal injury and mandatory statutory liability remains unaffected.

7. Retention of Title

Goods remain the property of MotoNavAdventure GmbH until full payment has been received.

8. Returns and Refunds

Returns, exchanges and refunds are governed exclusively by the applicable Return Policy published on MotoNavAdventure.com.

9. Intellectual Property

All content, trademarks, logos, product descriptions, images and other materials published on MotoNavAdventure.com remain the property of their respective owners and may not be copied, reproduced or used without prior written permission.

10. Privacy

The processing of personal data is governed by the Privacy Policy published on MotoNavAdventure.com.

11. Governing Law and Jurisdiction

These Terms and Conditions shall be governed exclusively by Swiss law, excluding conflict-of-law provisions.

The place of jurisdiction for all disputes arising out of or in connection with these Terms and Conditions shall be the registered office of MotoNavAdventure GmbH, unless mandatory Swiss law provides otherwise.
